SERAP Takes INEC to Court Over Political Donation Restrictions

The Socio-Economic Rights and Accountability Project (SERAP) has sued the Independent National Electoral Commission (INEC) over its alleged failure to disclose political donation limits ahead of the 2027 general elections.

SERAP filed the suit at the Federal High Court in Abuja, asking the court to compel INEC to state whether it has prescribed limits on political contributions under Section 91 of the Electoral Act 2026.

The organisation also wants the commission to publish any limits it has set and disclose the systems and procedures it has put in place to monitor political donations and campaign spending.

The suit, marked FHC/ABJ/CS/2114/2026, further seeks an order compelling INEC to disclose political parties’ financial records, including audited accounts, sources of funds, assets, liabilities and election expenditure returns for 2023 to 2025.

SERAP also asked the court to compel INEC to release its examination and audit reports on political parties, including reports submitted to the National Assembly, as well as details of actions taken over alleged political-finance violations.

The organisation argued that Section 91 of the Electoral Act gives INEC the power to limit individual contributions to political parties or candidates and require disclosure of the amount donated and source of funds. The 2026 Act also provides sanctions for exceeding limits prescribed by the commission.

SERAP said greater transparency was necessary as political parties and candidates had begun mobilising funds and preparing for the 2027 elections.

The organisation is also seeking details of how INEC plans to monitor cash and non-cash donations, digital and social-media advertising, political consultants and third-party campaign spending.

No date has been fixed for the hearing of the suit.
