Afghanistan has \u2018legalised\u2019 domestic violence in a troubling crackdown on women\u2019s rights.<\/p>\n\n\n\n
A new 90-page penal code introduced by the Taliban allows husbands to physically punish their wives and children \u2013 as long as the abuse does not result in \u201cbroken bones or open wounds\u201d.<\/p>\n\n\n\n
Under the new laws, a husband faces a maximum of just 15 days in prison in cases of \u201cobscene force\u201d, such as visible fractures or injuries. Convictions will be sought only if the wife can successfully prove the abuse in court.<\/p>\n\n\n\n
A married woman can also now be jailed for up to three months if she visits her relatives without her husband\u2019s explicit permission.<\/p>\n\n\n\n
The law uses language effectively treating wives as the \u201cproperty\u201d or \u201cslaves\u201d of their husbands, and strips away vital protections, such as the 2009 law on the Elimination of Violence Against Women (EVAW), which was introduced during the previous US-backed regime.<\/p>\n\n\n\n
Campaigners from exiled Afghan human rights group Rawadari, who obtained a copy of the Taliban\u2019s new penal code, warned in a statement that it would legitimise the \u201cabuse, maltreatment, and punishment\u201d of women and children \u2013 and expose them to \u201ccontinued domestic violence\u201d.<\/p>\n\n\n\n
Its new limits on women\u2019s rights to see their families also removes one of the few protections available in a country where there are few \u201cformal and legal remedies\u201d, they added.<\/p>\n\n\n\n
Rawadari demanded the \u201cimmediate halt of the implementation of the criminal procedure code\u201d by the Taliban courts, and called for the international community, the United Nations, and \u201cother relevant international bodies\u201d to \u201cutilise all legal instruments\u201d to prevent it coming into force.<\/p>\n","protected":false},"excerpt":{"rendered":"
